Terms and Conditions

These Terms and Conditions (the "Terms") govern access to and use of the KairosLink platform, operated by MITS GROUP LLC, a limited liability company organized in the state of New Mexico, United States ("MITS GROUP", "we"). By creating an account or using the service, you accept these Terms in full. If you do not agree, do not use the service.

1. Description of the service

KairosLink is a unified remote monitoring and management (RMM) and incident management (ITSM) platform with artificial intelligence features, intended for managed service providers (MSPs) and IT consultants to administer, monitor, support and manage tickets for computer equipment. All the features described are available in production.

2. Account and eligibility

To use KairosLink you must be of legal age with legal capacity to contract, and use the service in a professional or business context. You are responsible for the accuracy of your registration data, the confidentiality of your credentials and all activity performed under your account.

3. Acceptable use and authorization for remote access

By using KairosLink you represent and warrant that you have the necessary consent and authorization from the owners and users of the managed computers to install the agent, collect technical information, run commands and establish remote control sessions. You are solely responsible for obtaining and keeping those authorizations. KairosLink is a tool; its lawful and authorized use is your responsibility.

You agree not to use the service to access systems without authorization, for unlawful activities, to infringe third-party rights, or to distribute malicious software.

4. Plans, subscription and payments

KairosLink offers a 14-day free trial period and paid subscription plans with expanded capabilities. The prices, limits and conditions of each plan are stated on the platform and may be modified with reasonable notice.

Paid subscriptions are billed periodically on a monthly basis and renew automatically at the end of each period until you cancel. You can cancel the renewal at any time; cancellation takes effect at the end of the period already paid. Cancellation and refund terms are detailed in our Refund Policy.

Taxes applicable to the transaction are determined and settled by MITS GROUP LLC under the applicable regulations, and may be added to the price where appropriate. Any other tax that may apply to you outside the transaction is your responsibility, unless otherwise indicated.

5. Artificial intelligence features

The AI features generate suggestions, scripts, diagnostics and documentation in an automated way. These results may contain errors or be inaccurate. You are responsible for reviewing and validating any command or script before running it on a computer. KairosLink does not guarantee that AI outputs are correct, complete or suitable for a specific purpose.

6. Intellectual property

The KairosLink software, brand, design and content are owned by MITS GROUP or its licensors and are protected by applicable law. You acquire no rights over them beyond the limited, non-exclusive, non-transferable license we grant you to use the service in accordance with these Terms.

7. Availability and support

We strive to keep the service available and secure, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates or changes that temporarily affect availability.

8. Warranties and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind beyond those required by law. To the maximum extent permitted by applicable law, MITS GROUP shall not be liable for indirect or incidental damages, loss of profits or loss of data arising from the use of or inability to use the service.

9. Indemnity

You agree to hold MITS GROUP harmless against third-party claims arising from misuse of the service, from the lack of authorization to access computers, or from breach of these Terms or the law.

10. Suspension and termination

We may suspend or terminate an account for breach of these Terms or for uses that compromise the security or operation of the service. You may close your account at any time.

11. Changes

We may update these Terms. We will publish the current version on this page and indicate the date of the last update. Continued use of the service implies acceptance of the Terms in force.

12. Governing law and jurisdiction

These Terms are governed by the laws of the state of New Mexico, United States, without giving effect to its conflict of laws rules. Any dispute that cannot be resolved by mutual agreement shall be submitted to the competent courts located in the state of New Mexico, except where a mandatory rule applicable to consumers provides otherwise.

Governing language

This document is a translation provided for convenience only. The Spanish-language version is the legally binding text, and in the event of any discrepancy or conflict between the two versions, the Spanish version shall prevail.
